These are the terms and conditions (“Terms and Conditions”) upon which we supply Tickets and permit to entry to our Attraction.

1. DEFINITIONS

In these terms and conditions the following definitions shall apply: 

Attraction: Urban Playground, Arndale Centre, 99-101 Marsden Way Manchester M4 3AB or any part of it;

Event Outside our Control: any act or event beyond our reasonable control, including without limitation epidemics of infectious diseases, war (whether declared or not), threat of war, strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.

’Us’/’We’/’Our’: Mellors Group UP No 1 Limited (Company Registration Number 13500421) registered in England and Wales, whose registered office address is at 57 Front Street, Arnold, Nottingham, Nottinghamshire, United Kingdom, NG5 7EA trading as Urban Playground.

Ticket: A valid ticket allowing the holder entry to the Attraction.

 

2. CONTACT URBAN PLAYGROUND

2.1          You can contact us by writing to us at [email protected]  or Urban Playground, Arndale Centre, 99-101 Marsden Way Manchester M4 3AB.

2.2          When contacting us please provide as much information as possible in reference to your booking.

 

3. BOOKINGS

3.1          These Terms and Conditions apply whether you make a booking via our website, by email, post, telephone or in person.

3.2          You will submit your booking to us but this does not mean we have accepted it. Our acceptance of your booking will only occur when we send you a booking confirmation at which point a contract will come into existence between you and us.

3.3          We do not accept bookings from persons under the age of 18.

3.4          Tickets you purchase are for personal use and cannot be exchanged, transferred or sold on for profit, loaned or given away to or used by a third party.  If you breach this condition, we will be entitled to refuse access to the Attraction and cancel the Tickets without compensation.

3.5          To prevent fraud, we may carry out checks or you may be asked to provide additional identification after your booking so we can verify your purchase as legitimate. If you refuse to provide us with the additional identification and/or we suspect fraud, we may cancel your booking and/or Tickets.

3.6          We will process your personal details in accordance with these Terms and Conditions and our Privacy Policy. You acknowledge that the processing of your personal information is necessary for us to perform our contract with you. We also reserve the right to use your personal details to contact you in relation to service information, including, but not limited to, information about changes to these Terms and Conditions.

3.7          You must inform us of any change of address, contact phone number or email address, both before and after receipt of the tickets. Our contact details are included in these Terms and Conditions. Our preferred method to contact you is email. You should take care to provide a current, valid email address and be aware that your email filter settings may treat our emails as spam or direct them to your junk folder.

3.8          We operate a dynamic pricing model, meaning that ticket prices may go up or down. Throughout the year we may offer seasonal promotions and discounts. The price of your Ticket(s) will be confirmed at the time of your booking.

3.9          We try to ensure all prices on our website are accurate, but errors may occur. If we discover an error in the price of Tickets you have ordered we will contact you by email as soon as possible using the email address you provided when booking your ticket and we will give you the option of either cancelling your booking (in which case you will be refunded the price of Tickets and any booking, transaction or supplementary fees you have paid) or continuing to purchase the Ticket(s) at the correct price. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the booking process within a reasonable period of time, we will treat the booking as cancelled and notify you by email.

3.10        By making a booking you agreeing to our disclaimer which can be viewed at https://www.urbanplayground.co.uk/manchester/info/disclaimer.

3.11        If you are making the booking on behalf of others in your group, it is your responsibility to ensure that these additional players agree to these Terms and Conditions and are in receipt of all relevant information relating to the booking. We shall not be responsible if members of your group are unable to participate, as a result of you failing to provide them with all the relevant information.

 

4. DELIVERY

4.1          Tickets will be sent to you by email.

4.2          It is your responsibility to ensure that you have provided us with a valid email address when making your booking.

4.3          Tickets must either be printed or displayed on a digital device when arriving at the Attraction. You are then required to utilise the QR code scanner to check-in and operate the equipment at the Attraction. It is your responsibility to ensure you have access to the QR codes provided for use at the Attraction. We will not be responsible if you do not have the QR codes to play. No refunds will be given.

4.4          It is your responsibility to check your Tickets upon receipt and advise us promptly of any errors. Mistakes made when ordering cannot always be corrected and any corrections are discretionary and may attract a fee. Refunds are not available.

 

5. CANCELLATION, CHANGES AND REFUNDS

5.1          Unless specifically stated otherwise in these Terms and Conditions, refunds are not available in any circumstances. This does not affect your statutory rights as a consumer.

5.2          We reserve the right to vary the opening and closing dates and times of the Attraction and to close, remove or cancel all or any part of the events or facilities within the Attraction for any reason including, but not being limited to technical, health and safety and/or operational reasons or due to special events or private functions.

5.3          You should check that your booking is going ahead at the scheduled date and time as we can’t guarantee to inform you of any changes to or cancellation of your booking. We won’t be responsible for any costs you may incur for travel, accommodation, any other related goods or service or other compensation.

5.4          If we do cancel your booking or make significant changes to the Attraction, date, or session time, we will endeavour to inform you in advance by email using the email address you provided when making your booking. In urgent cases, we may attempt to contact you by telephone using the contact number you have provided when making your booking.

5.5          If we need to reschedule your booking you will be given the option of exchanging your tickets for a new date/time. Reschedule requests made within 24 hours of your booking will incur a £5 rebooking fee. Tickets for sessions that have a higher value will incur a cost that is equal to the difference in price. Refunds are not available.

5.6          If we cancel a booking you will be given the option of exchanging your tickets for a new date/time. If the alternative options are unsuitable you may be offered a refund. Please note that any administration and transaction fees are not refundable in these circumstances.

 

6. EVENTS OUTSIDE OUR CONTROL

We cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by or you otherwise suffer any damage or loss as a result of an Event Outside of our Control.

 

7. COVID-19

7.1          If you choose to book during the COVID-19 global pandemic you do so in the full knowledge that a change in the current legislation or government guidance may mean that you are no longer able to attend the Attraction.

7.2          If we are unable to operate the Attraction as a result of a pandemic, a change in legislation and or government guidance, all affected customers will have the ability to reschedule their booking for a time in the future. We are unable to offer a refund under such circumstances and cannot be held responsible for any resulting costs you may incur for travel, accommodation, any other related goods or service or other compensation.

 

8. ATTENDING THE ATTRACTION

8.1          Admission to the Attraction is subject to these Terms and Conditions. If you breach any of these Terms and Conditions you may be refused admission or removed from the Attraction without any right to a refund.

8.2          Whilst inside the Attraction, you must comply with any reasonable instructions given to you by our personnel or any third party instructed on our behalf.

8.3          You will need to comply with health and safety rules and any security requirements we have in place at the Attraction including, but not limited to, security searches for the safety of those attending the Attraction.

8.4          We reserve the right to refuse admission or remove you from the Attraction without any right to a refund in certain circumstances and these are likely to include if you have consumed alcohol or illegal substances before attending, are involved with abusive, threatening, drunken or other anti-social behaviour, or carry offensive weapons or illegal or prohibited substances or make unauthorised audio, video or photographic recordings.

8.5          The Attraction includes vigorous activities and a high-tech mini golf course that has steps and bespoke features.  By attending the Attraction you accept that you have a duty to take reasonable steps to ensure your own safety, taking into account any personal medical conditions. Care and attention must be paid in the venue to avoid trips and falls

8.6          Persons aged under 18 years will not be permitted entry into the Attraction unless they are accompanied by a responsible adult.

8.7          THE CUBE Live is open to guests aged 9 years of age and over. Bookings with guests aged between 9 and 15 years of age must be supervised by an adult aged 18 years or above.

8.8         PHOTOSENITIVITY WARNING

THE ATTRACTION IS A HIGHLY SENSORY EXPERIENCE THAT INCLUDES FLASHING IMAGES AND LIGHTS THROUGHOUT. THIS MAY BE A CONCERN FOR THOSE WHO MAY OR HAVE SUFFERED FROM SEIZURES OR EPILEPSY.

PEOPLE WITH SENSITIVITIES TO FLASHING IMAGES AND LIGHTS ARE ADVISED TO CONSULT A DOCTOR PRIOR TO THEIR VISIT IF THIS IS A CONCERN.

8.9          THE CUBE Live is played in teams of 4 and under no circumstances can persons under the age of 16 play on their own without a supervising parent/guardian.

8.10        THE CUBE Live is played in groups of a maximum of 4 people and each Ticket admits 2 players; this is due to the way that the games are designed as odd numbered players is not possible. If you purchase Tickets for 2 persons only your selected group/ timeslot you may have additional players added to your group to create a group of 4. If you purchase more than 4 Tickets in multiples of 2, additional players will be required to play in a separate group that you may not be able to experience the event with for the entirety of the experience, lasting on average 1.5 hours.

8.11        Putters is open to guests aged 5 years of age and above. Children aged 15 and under require a supervising adult.

8.12        Putters is played in groups of a maximum of 6 people and each Ticket admits 1 player. Under extremely busy circumstances, if you purchase fewer than 6 tickets for your selected group/ timeslot, you may have additional players added to your group. If you purchase more than 6 tickets, additional players could be required to play in a separate group that you may not be able to experience the activity with for the entirety of the experience, lasting on average 45 minutes for 9 holes and 1.5 hours for 18 holes.

8.13        Upon registering to book any activity at the Attraction, you will be required to accept a health and safety waiver/disclaimer, including ensuring that information is provided to all players. By accepting these Terms and Conditions at the time of registration, you are confirming it is your responsibility to inform all players and confirm their acceptance of these Terms and Condition. If other players decide at any point after purchase they do not accept these Terms and Conditions, no refunds will be offered.

8.12        On the check-in kiosk each player will be required to accept the terms of the disclaimer individually. Failure to accept this will result in you being unable to play the attraction, and no refund will be offered. This is to ensure the protection of our guests and staff. 8.13        Please arrive 15 minutes before the time stated on your Ticket. Latecomers may not be admitted and no refund will be offered.

8.14        When attending the Attraction, please ensure that you have carry proof of age.

8.15        The Attraction operates outside of the opening hours of the Arndale Centre. As such, a specific route for gaining access to and egress from the Attraction is required. If you utilise the Arndale Centre carpark, you may be required to leave the Arndale Centre and access the car park via a different route. Please ensure that you obtain the required information relating to your visit to access and egress the Arndale Centre. Out of hours visits are conducted via the Exchange Square/Exchange Court doors.

8.16        We use CCTV cameras to assist in the proper running of the Attraction. However, we do not make any representation as to the extent of coverage provided by the cameras. All items, belongings and other property brought into the Attraction by guests are at their own risk and we accept no liability for any loss or damage to such property. As such, we recommend that guests do not bring valuables to the Attraction.

8.17        Unless it is expressly prohibited, you may take photographs and/or video recordings of the of the Attraction provided that these are solely for private use and are not sold or used for any commercial or public purpose.  You agree that we or any authorised third party may use such images in perpetuity in any promotional or publicity material in any format whatsoever. You further agree that all copyright and any other intellectual property rights that subsist in or arise out of these materials shall be absolutely owned by us or such authorised third party (subject to our agreement) as the case may be.

8.18        The Cube student discount: We offer student discount of 25% off THE CUBE tickets on Mondays to Thursdays, walk-ins only. Offer valid from Thursday, 28th September 2023. Cannot be used in conjunction with any other offer. Student status must be verified by presenting a valid Student ID on arrival at Urban Playground. Promoter reserves the right to terminate or modify the promotions and/or Terms and Conditions at any time.

8.19        Putters student drinks promotion: One free drink per person when buying a round of golf Monday to Friday at Putters, for walk-ins only. Offer valid from Thursday, 28th September 2023.  Drink option includes cocktails (Mojito, Sex on the Beach and Tequila Sunrise), bottled beer, single house spirit with mixer, 125ml house wine, Pepsi or Pepsi Max, lemonade, juices (choice of Apple, Orange, Cranberry and Pineapple) only.  Cannot be used in conjunction with any other offer. Student status must be verified by presenting a valid Student ID on arrival at Urban Playground. Offers are subject to change. Promoter reserves the right to terminate or modify the promotions and/or Terms and Conditions at any time.

 

9. PRIVACY POLICY

10. GIFT TICKET/ VOUCHERS

10.1        Your gift ticket/ voucher is valid for 12 months from the date of purchase. Tickets must be booked and redeemed within this period.

10.2        Gift Vouchers are non-refundable.

10.3        The value of a Gift Voucher is redeemable against the face value of Tickets in your basket. If the value of your basket is higher than the value of your gift voucher you will need to pay the balance.

10.4        Should the value of your gift voucher exceed the amount in your basket the remaining balance is forfeited. No cash value, or change, will be given.

 

11. GENERAL

11.1        These Terms and Conditions and any contract between you and us are governed by English law and any disputes arising out of them are subject to the exclusive jurisdiction of the English Courts.

11.2        No other person shall have any rights to enforce any of terms of the contract between you and us, whether under the Contracts (Rights of Third Parties Act) 1999 or otherwise.

11.3        We reserve the right to amend these Terms and Conditions from time to time and the date these Terms and Conditions were last updated is stated at the beginning of these Terms and Conditions. When you order Tickets from us, the Terms and Conditions at the time of your booking will apply to your contract with us.

11.4        We do not accept any responsibility for any loss and/or damage you suffer as a result of you failing to comply with these Terms and Conditions. This does not affect any of your statutory rights or any liability on our party which cannot be excluded by law.

11.5        Each of the paragraphs of these Terms and Conditions operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
